Terms of Use
These Terms of Use govern your use of Blood Oxygen Tracker: SpO2, including its iPhone and Apple Watch apps (the "App"). By downloading or using the App, you agree to these Terms and Apple's applicable App Store terms.
Eligibility and acceptance
You must be at least 13 years old, or the minimum age required in your country, to use the App. If you are under the age of legal majority, a parent or guardian must review and accept these Terms for you. If you do not agree to these Terms, do not use the App.
Description of the App
Blood Oxygen Tracker: SpO2 is a general wellness companion that helps you view and organize blood-oxygen, heart-rate, and sleep information; log readings; estimate heart rate with the iPhone camera; use compatible Apple Watch features; and create reports.
No medical advice or emergency use
Do not rely on the App to make medical decisions or in an emergency. Measurements and imported data may be delayed, incomplete, inaccurate, or affected by devices, permissions, movement, technique, or manual entry. Verify important information independently and consult a qualified healthcare professional. If you feel unwell or may be experiencing an emergency, contact local emergency services immediately.
License
The App is licensed, not sold. Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control as permitted by the App Store usage rules and Apple's Standard End User License Agreement.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, interfere with, or attempt to gain unauthorized access to the App, except where applicable law does not allow that restriction. You may not use the App unlawfully or to infringe another person's rights.
Your responsibilities
You are responsible for the accuracy of information you enter, for reviewing imported readings, for maintaining the security of your devices, and for keeping suitable backups. You are also responsible for obtaining any professional advice appropriate to your circumstances.
Apple Health, camera, and third-party services
Some features require your permission to use Apple Health, the camera, Apple Watch connectivity, or notifications. You can change permissions in iOS or the Health app, although doing so may limit functionality. Your use of Apple services, Adapty subscription services, and other third-party services is also subject to their terms and policies.
Subscriptions and payments
Some features may require a paid subscription. Available plans, prices, trial terms, and included features are shown in the App before purchase. Payment is charged to your Apple ID through the App Store.
Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. Your Apple ID may be charged for renewal within 24 hours before that period ends. You can manage or cancel subscriptions in your Apple ID subscription settings. If a free trial is offered, any unused portion may be forfeited when you purchase a subscription. Refunds are handled by Apple under App Store rules and applicable law.
Intellectual property
The App, including its software, design, text, graphics, and branding, is owned by the developer or its licensors and is protected by applicable intellectual-property laws. You retain ownership of the information you enter into the App.
Maintenance, changes, and availability
We may update, change, suspend, or discontinue features to improve the App, address security or legal requirements, or reflect third-party platform changes. We do not guarantee that the App will always be available, uninterrupted, secure, or error-free, or that it will work with every device or operating-system version.
Disclaimer of warranties
To the fullest extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, the developer and its affiliates, officers, employees, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, use, profits, or goodwill, arising from your use of or inability to use the App. We are not responsible for health decisions made based on the App. Where liability cannot be excluded, it is limited to the greater of the amount you paid for the App during the 12 months before the claim or USD $100, unless applicable law requires otherwise.
Termination
You may stop using the App at any time. Uninstalling the App does not cancel an active subscription; subscriptions must be canceled through Apple. Your license ends automatically if you materially violate these Terms. Provisions that by their nature should survive termination will remain in effect.
Legal compliance and Apple
You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on a U.S. Government prohibited or restricted-party list. Apple is not responsible for the App or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes to these Terms
We may update these Terms from time to time. The updated version will be posted here with a revised effective date. Your continued use of the App after an update means you accept the revised Terms, to the extent permitted by law.
